Only time they should not be awarded first is if they don't get out of the way or if the pitched ball was called a strike or would have been called a strike. That would mean the batter was in the actual strikezone or swung at the pitch before it hit her.

Or a swinging strike. I had to protest a new umpire's call that gave the batter 1st base on a bunt attempt where the ball hit her. I won. My first question to him was, "Did she offer?" He said, "Yes, but it doesn't matter. She was hit by the pitch." At this time, I told him I wanted to protest his interpretation of the rule.
