Take a look at NCAA Rule Book on pitching, Rule 10. They have an illustration of bringing the ball up above the head prior to delivery under the section entitled "legal pitching motions".

I don't doubt what you say. I don't have an NCAA rulebook. Can they bring it up to exactly 12:00 in their pre-motions and be legal? Yes. Can they bring it farther back PAST 12:00 and be legal? NO. HOWEVER, the question of did the pitcher bring it past 12:00, that is stilll a judgement call.

Since it is in their pre-motions and happens way before they bring it back and start their forward motion, it adds nothing to the pitch (no advantage, not to open that can of worms). Unless they bring it way back behind and over their head, doubt if we would ever see that called.

Called during Olympic competiton? Not in our lifetime. Too many other violations for them to stay busy with watching.
