Here's the scenario: runner on 1st, ground ball to 2nd she flips to short for the force out, SS throws to 1st for double play. Ball is thrown into the dugout. Base ump calls the girl out and 2nd (correct call) and awards the runner going to 1st 2nd base because the ball left the field of play. The home plate ump walks out to base ump and they have a discussion. The home plate ump awards the base runner 3rd. His judgement was that she was through 1st base when the ball left the SS hand. Now the location of the runner at the time of the throw is a judgement call and i am not going to argue that. My question if the runner is past 1st base when that throw is made do they have to make an attempt to go to 2nd base to be awarded 3rd base?

Runner never has to attempt anything to be awarded bases on a ball thrown into dead ball territory. The award depends completely on the runners location at the time the ball left the fielders hand. If the runner had not yet reached 1st when the throw was made the award is 2nd base, if the runner had reached 1st at the time of the throw then the award is 3rd base. 2 bases from the runners location at the time of the throw.
